HAVANA Act Benefits Program
On October 8, 2021, the President signed the “Helping American Victims Affected by Neurological Attacks” (HAVANA) Act of 2021 (Public Law 117-46). In the HAVANA Act, Congress authorized Federal Government agencies to compensate affected employees, former employees, and their dependents for qualifying injuries to the brain.

Payments Under the Helping American Victims Afflicted by Neurological Attacks (HAVANA) Act of 2021
This memorandum provides operational guidance concerning administration of the procedures in Title 32, Code of Federal Regulations (CFR), Part 49, that are applicable to requests for the Helping American Victims Afflicted by Neurological Attacks Act of 2021 (HAVANA Act) payments pursuant to section 2680b(i) of Title 22, United States Code (USC). The Deputy Assistant Secretary of Defense for Civilian Personnel Policy (DASD(CPP)) is responsible for policy oversight of the Department's HAVANA Act payment program and for taking final agency action on requests for payment. The Director, Defense Human Resources Activity (DHRA), through the Defense Civilian Personnel Advisory Service (DCPAS), is responsible to administer the program pursuant to Title 32, CFR, Part 49 and this operational guidance.
